Terms of service
Last updated:
1. The agreement
1.1 These terms are an agreement between you, the business named at checkout ("you"), and Narto ApS, a Danish company with registration number (CVR) 46813227, Lynghusene 26, 4571 Grevinge, Denmark, which runs LocalBooked ("LocalBooked", "we").
1.2 You accept these terms when you tick the box at checkout, when you pay, or when you start using the service, whichever happens first. Accepting them electronically has the same effect as a signature.
1.3 The service is for businesses only. You confirm that you are buying for a business and not as a consumer, and that you have the authority to accept these terms on behalf of that business.
1.4 The agreement consists of these terms, our Data Processing Addendum at localbooked.co/dpa, and the plan and price shown at checkout. If the Data Processing Addendum and these terms say different things about personal data, the Data Processing Addendum applies.
1.5 We may transfer the agreement to another company that runs LocalBooked. We tell you by email first. Your plan, your price and your rights under these terms stay the same.
2. The plans
2.1 Website, USD 147 per month:
- A new website on your domain, built for your trade and your city.
- Hosting and setup on your domain, including DNS.
- Every change to the website you ask for (section 4).
- Inquiries from your website sent straight to you.
- A report every two weeks on visits and inquiries from your website, including taps on your phone number.
2.2 Booked, USD 247 per month. Everything in Website, plus:
- Geo-SEO (section 10).
- A local phone number for your website that rings through to your phone (section 5).
- 5-star reviews on autopilot (section 6).
- Missed call text back (section 7).
- AI chat on your website (section 8).
- Old lead follow-up (section 9).
- One business per trade in your area (section 11).
2.3 Fully Booked, USD 747 per month. Everything in Booked, plus:
- One blog post a month, which you approve before it goes live (section 10).
- A monthly strategy call, if you want one (section 10).
- Your change requests go first in line (section 4).
2.4 Anything not listed for your plan is not included unless we agree otherwise in writing. Examples are advertising and ad budgets, social media, online shops and payments on your website, email hosting, an AI that answers your phone calls, custom software, and legal review of your website.
2.5 We may use subcontractors and software tools, including AI tools, to deliver the service. We remain responsible to you for their work.
2.6 We may improve or replace the tools and methods we use to deliver a part of your plan. If we stop offering a part of your plan, we tell you by email at least 30 days before, and you can cancel without the 30 days' notice in section 17.
3. Getting started
3.1 After you sign up, you fill in a short onboarding form with your business details, services and service areas. On Booked and Fully Booked, the form also asks for your business's legal details, which US carriers require before a business can send texts (section 5.3).
3.2 We build the website from public information about your business and from what you give us. The website goes live after your first payment and after you have given us the access we need to your domain. We aim to go live quickly. That depends on your domain provider and on how fast you give us access, so it is a goal and not a guarantee.
3.3 The website, Geo-SEO and the AI chat can start without approval from carriers. Reviews on autopilot, missed call text back and old lead follow-up by text start when carriers have approved the registration of your business (section 5.3).
3.4 The price of your plan does not change, and is not reduced, while we wait for information from you or for approval from carriers.
4. Changes to your website
4.1 All changes to your website are included: text, prices, photos, hours, services, service areas, new sections and new pages.
4.2 Send requests by email or in the channel we set up for you. We aim to make changes within 24 to 48 hours on business days. That is a target, not a guarantee. On Fully Booked, your requests go before requests from customers on other plans.
4.3 We may say no to a request that is unreasonable in size or number, that is unlawful or misleading, that would harm the website's security or performance, or that is not about your website.
5. Your local number and text messages
5.1 On Booked and Fully Booked, we set up a local phone number for your website. Calls to it ring through to your phone. Your own number keeps working.
5.2 The number is provided through our phone provider and stays on our account. It is not transferred to you, also not when the subscription ends. Texts from it are sent in your business's name, and your business is the sender.
5.3 US carriers require a business that sends texts from an ordinary local number to be registered (known as A2P 10DLC). You give us your business's correct legal details, such as its legal name, its EIN if it has one, its address and a contact person. You authorize us to register your business and its types of messages with carriers in your name. We never ask for a Social Security number. Carriers decide whether and when to approve a registration. It often takes about a week, but we cannot promise a date. If a registration is refused because of the details you gave, you correct them. If carriers will not register your business at all, we tell you, and you can move to the Website plan from your next billing date.
5.4 The number, the registration and the texts the system sends are included in the price of your plan for normal use. Normal use means the parts of the system described in sections 6, 7 and 9, used for one business. If your use goes far beyond that, for example texts to very large lists, we tell you and agree a price with you before we continue.
5.5 We set automated texts to go out only during the day, by default between 9 a.m. and 8 p.m. in your business's time zone. This does not apply to missed call text back, which answers someone who has just called you. This helps, but it does not replace your responsibility under section 12.
5.6 Anyone who replies STOP, or a similar word, stops receiving texts from your number. This happens automatically. If someone asks you in another way to stop texting them, for example by phone, by email or in person, tell us without delay so we can stop the texts. We do not text them again unless they opt back in.
5.7 Replies to texts from your number are sent on to you.
5.8 We do not turn on recording of calls to your local number unless you ask us to. If you ask us to, you are responsible for telling callers and for getting any consent the law requires. Some states require everyone on a call to agree to the recording.
6. Reviews on autopilot
6.1 After a job, you add the customer's first name and mobile number in a simple form that we give you. The customer gets a text from your business with a link to your Google page, and up to three reminders. The reminders stop as soon as the customer taps the link or replies STOP.
6.2 By adding a customer to the form, you confirm that the person is a real customer of your business, that you have done a job for them, and that they have agreed to receive the text from your business. The form saves your confirmation with the date and time.
6.3 The texts contain only a thank-you or a reminder, your business name, the link to your Google page and how to opt out. They contain no offers or advertising. A customer gets at most four texts per job: the request and up to three reminders.
6.4 Every customer gets the same request and the same link. We do not filter out unhappy customers or send only happy customers to Google, which is known as review gating. We do not set it up that way, even if you ask us to.
6.5 You do not offer anything in return for a review, such as a discount, a gift or money. You do not ask only for positive reviews, write or buy reviews, or ask staff, family or friends to review your business. Google's rules forbid this, and parts of it are illegal under US federal law.
6.6 We do not promise a number of reviews or a star rating. Google decides which reviews it publishes and keeps.
7. Missed call text back
7.1 When a call to your local number is not answered, the caller gets a text from your business, usually within a minute, saying that you will call back.
7.2 It is a text, not an AI on the phone. Calling back is your job.
7.3 Not every missed call can get a text, for example when the number is hidden, when the caller is on a landline, or when a carrier blocks the message.
8. AI chat on your website
8.1 The chat answers visitors on your website, asks about the job, the address, the timing and their contact details, and sends them to you.
8.2 The chat tells visitors that it is an automated assistant.
8.3 We set it up so that it does not quote prices or make promises on your behalf, and so that it points people with an urgent problem to your phone number. AI software can still misunderstand or make mistakes. Check the details with the customer before you rely on them.
8.4 The chat answers from your website and from what you tell us. Tell us when something changes, such as your hours, services or service areas.
8.5 Nobody watches the chat in real time, and it can be unavailable at times. It is not a way to handle emergencies.
9. Old lead follow-up
9.1 We send a follow-up to people you quoted who never booked and to past customers, from a list you give us or from contacts already in your system. Replies are sent on to you.
9.2 You approve the message, the list and how often it goes out, and you tell us to send it. Nothing is sent before that.
9.3 We send the follow-up by text only to contacts who have agreed in writing to receive marketing texts from your business, for example by ticking the box on the form on your website or by signing. A verbal yes is not enough for this. When the agreement comes through your website, the system saves how and when it was given. For other contacts, by marking a contact as having agreed, you confirm that you can show their written agreement.
9.4 Everyone else can get the follow-up by email instead, if you have their email address. Every email includes your business's postal address and a way to unsubscribe.
9.5 Every text names your business and says how to opt out. Before we send, you remove anyone who has asked you not to contact them. We do not send follow-ups to lists that were bought, rented or collected from others.
10. Geo-SEO, blog posts and strategy calls
10.1 Geo-SEO means that we build and maintain your website so that search engines and AI search tools can read it: pages for your services and service areas, clear titles and descriptions, structured data and a fast website. Results on Google and in AI search take months and are not guaranteed (section 26).
10.2 On Fully Booked, you get one blog post a month about your trade and your area. We may use AI tools to help write it. Nothing is published until you approve it. When you approve a post, you are responsible for the facts in it. A post that is not used in a month does not carry over to the next month.
10.3 On Fully Booked, you can have one strategy call a month with us about your website and your system. A call that is not used in a month does not carry over.
11. One business per trade in your area
11.1 While you are on Booked or Fully Booked and your payments are up to date, we do not provide Booked or Fully Booked to another business in your trade in your area.
11.2 Your trade and your area are the ones we confirm to you by email when you sign up. Your area is your city. In a very large city, your area is a part of the city that we agree with you, so we may serve more than one business in your trade in the same large city.
11.3 It is first come, first served. If we already serve a business in your trade in your area, we tell you before you sign up.
11.4 It does not cover the Website plan. We may provide the Website plan to other businesses in your trade in your area. It also does not cover businesses in other trades, or what other companies do.
11.5 It ends when your Booked or Fully Booked plan ends, when you move to the Website plan, or when a payment is more than 7 days overdue.
11.6 If we break this section by mistake, tell us. If we have not fixed it within 30 days, you can end the subscription with immediate effect, and we refund the part of the month you have paid for and not used. That is your only remedy.
12. Your responsibility for messages and contacts
12.1 Your business is the sender of every text and every email that the system sends to your customers and leads, and your business is responsible for them. We provide and set up the tools. Texts go out only when you set them off, for example by sending the review form or by a call you miss, or after you have approved the message and the list.
12.2 You are responsible for:
- having the consent the law requires before a text is sent, keeping proof of it for at least 4 years, and showing it to us within 5 business days if we ask,
- the contacts and lists you give us or add to the system, and marking correctly which contacts have agreed to receive texts,
- honoring opt-outs, and telling us about opt-outs you receive outside the system,
- checking Do Not Call lists where the law requires it,
- following the laws on texts, calls and emails that apply to your business, including the Telephone Consumer Protection Act, state laws on telemarketing and texting, the CAN-SPAM Act, and carrier rules,
- following the privacy laws that apply to your business and to the people in your system, and giving them any privacy notice your business needs,
- the business details you give us for the carrier registration being correct.
12.3 We may ask to see proof of consent before we send. We may refuse, pause or stop a message, a list or a campaign if you cannot show it, if we think it breaks the law or carrier rules, or if a carrier or our phone provider blocks or flags it. We tell you when we do.
12.4 We do not give legal advice. If you are unsure what the law requires of your business, ask a lawyer.
12.5 Fines, penalties, carrier fees and claims caused by messages sent for your business, or by contacts and consents you gave us, are yours. Section 28 applies.
13. Price, billing and automatic renewal
13.1 The price is the monthly price of your plan: USD 147 for Website, USD 247 for Booked and USD 747 for Fully Booked. There is no setup fee. If the checkout page shows a different price, the price at checkout applies.
13.2 The subscription renews automatically every month until it is cancelled. Your card is charged when you sign up and then every month on the same date, through our payment provider Stripe. You authorize us to charge the card on file for each payment that falls due.
13.3 You keep your payment details up to date.
13.4 Prices do not include sales tax, VAT or similar taxes. If such taxes apply to your purchase, they are added or are yours to pay.
13.5 We may change the price with 3 months' notice by email. You can cancel before the new price starts.
14. Missed payments and payment disputes
14.1 If a payment fails, we tell you by email and may try the charge again.
14.2 If a payment is still unpaid 7 days after it was due, we may take the website offline and pause the rest of the system. Both come back when the payment is made.
14.3 If a payment is still unpaid after 30 days, we may end the subscription.
14.4 If you think a charge is wrong, contact us first at [email protected] and give us 10 business days to sort it out before you dispute the charge with your bank or card issuer.
14.5 If you dispute a charge that was correctly made under these terms, that is a breach of these terms. We may take the website offline and pause the system while the dispute is open, and you owe us the disputed amount and any dispute fee our payment provider charges us.
15. Refunds
Payments are not refunded. That includes a month that has started, a month in which you did not use the service, and a period in which a part of the service was waiting for approval from carriers. The only exceptions are in sections 11.6, 19.2 and 28.3.
16. Changing plans
16.1 You can move to another plan by email. The change takes effect from your next billing date, unless we agree on an earlier date.
16.2 If you move from Booked or Fully Booked to Website, the parts that are not in Website stop when the change takes effect, including section 11. Sections 20.3 and 20.4 apply to the local number and your contacts.
17. Cancelling
17.1 There is no long-term contract. You can cancel at any time with 30 days' notice.
17.2 To cancel, send an email to [email protected] from the email address on your account. We confirm by email. The 30 days run from the day we receive your email.
17.3 The subscription runs until the 30 days have passed. If a monthly payment falls due in that period, it is charged, and the subscription then runs to the end of the month that payment covers.
17.4 Stopping your card, or not using the service, is not a cancellation.
18. Buyout
18.1 You can buy the website for a one-time payment of USD 997, at any time while the subscription runs and no later than the day it ends.
18.2 After the payment we send you the website files within 10 business days, and we start the transfer of any domain we registered for you. The transfer needs you to have an account with a domain provider, and its timing depends on that provider.
18.3 A buyout covers the website only. The local number, the automations, the AI chat, the reports and our software stay with us. The files are delivered as they are. Forms, the chat, reports and other functions that run on our systems stop working when the website leaves our hosting. Stock photos, fonts and other third-party material follow their own license terms.
18.4 After a buyout we no longer host, update or support the website, and the subscription ends without the 30 days' notice.
19. Suspension and ending by LocalBooked
19.1 We can end the subscription at any time by email, with immediate effect.
19.2 If we end it for a reason other than those in 19.3, we refund the unused part of the month you have paid for.
19.3 There is no refund if we end it because you have not paid, because you have disputed a correct charge, or because you have broken these terms.
19.4 We may take the website offline or pause all or part of the system at once, without ending the subscription, if content or messages look unlawful or misleading, if there is a security risk, if a payment is overdue under section 14, if a carrier or our phone provider flags your messages, or if someone claims the content infringes their rights. We tell you by email and restart when the issue is solved.
20. When the subscription ends
20.1 The website is taken offline, and the automations, the AI chat and the reports stop. You do not keep the website, unless you have bought it under section 18.
20.2 A domain you own stays yours. You point it somewhere else, and we stop using the access you gave us. A domain we registered stays with us, unless you have bought it under section 18. We may let it expire.
20.3 The local number stays with us and is not transferred to you. We stop forwarding calls and texts from it, and we may release it.
20.4 If you ask within 30 days after the end, we send you your contacts, your inquiries and the material you gave us. After that we delete them, as the Data Processing Addendum describes, except what the law requires us to keep.
20.5 Sections 12, 14.5, 15, 20, 21, 27, 28, 29, 34 and 35 continue to apply after the end.
21. Ownership
21.1 We own the website and the system: the design, the code, the layout, the text and images we made, the automations, the set-up of the chat and our templates. While the subscription runs and is paid, you have the right to use them for your business. That right ends when the subscription ends.
21.2 You own what you give us: your logo, photos, text and business details. You also own your contacts and the information about your customers and leads in the system. You give us the right to use all of this to deliver the service for as long as the subscription runs, and afterwards as section 20 and the Data Processing Addendum describe.
21.3 A domain you already have stays yours. A domain we register for you belongs to us, unless you buy it under section 18.
21.4 Stock photos, fonts, icons, map embeds, open-source software and other third-party material stay subject to their own license terms.
21.5 We may reuse our designs, templates, automations and know-how for other customers. We do not reuse your logo, your photos, your contacts or your business details for other customers.
21.6 If you give us ideas or feedback about the service, we may use them freely.
22. Your content and your website
22.1 We build the first version from public information about your business, such as your Google listing, your current website, your social media pages, and reviews and photos that are publicly posted about your business.
22.2 You review the website before it goes live. By letting it go live, you approve its content. If you later find something wrong, tell us and we change it.
22.3 You are responsible for the content being correct and lawful. That includes prices, services, service areas, licenses and certifications, insurance and warranty statements, guarantees, customer reviews and testimonials, and before and after photos.
22.4 You confirm that you have the right to use your business name, logo, photos, reviews and any other material that is shown on the website, whether you gave it to us or we collected it from your public pages. If you do not, tell us and we remove it.
22.5 You give us the access to your domain that we need, you answer our questions within a reasonable time, and you keep the email address on your account current.
22.6 Your website comes with a standard privacy policy and website terms page, including the wording about text messages that carriers look for. These are templates filled in with your business details. They are not legal advice and have not been reviewed by a lawyer. You are responsible for checking that they fit your business, and you can ask us to change them at any time.
22.7 You are responsible for your business and its website following the laws that apply to you. Examples are advertising rules, license and registration disclosures for your trade, privacy notices, cookie rules, and accessibility requirements such as the Americans with Disabilities Act. We follow common good practice for accessibility when we build. We do not guarantee that the website meets any specific legal or technical standard. If you tell us something needs to be fixed, we fix it as a change under section 4.
23. Acceptable use
You do not use the service:
- to send spam, or texts or emails without the consent the law requires,
- to text people from a list that was bought, rented or collected from others,
- for products or services that carriers restrict or do not allow, such as cannabis, high-risk loans, debt collection, gambling or adult content,
- for content that is unlawful, misleading or harassing, or that infringes someone else's rights,
- to get around our security, or to copy our system to build a competing service.
24. Personal data
24.1 When the system handles personal data about your customers, leads and website visitors, you decide what it is used for, and we handle it on your behalf under the Data Processing Addendum at localbooked.co/dpa.
24.2 We do not sell that data and we do not use it for anyone else. We look at the number and type of inquiries, messages and reviews to report to you and to suggest improvements to your system.
24.3 Texts, calls and emails can be delayed, blocked or sorted as spam. We do not guarantee that every inquiry or message reaches its recipient. Check your phone, your inbox and your spam folder regularly.
24.4 Our privacy policy at localbooked.co/privacy explains how we handle your own contact and payment details.
25. Other companies' services
25.1 The service depends on services from other companies, such as hosting, domain registration, phone and text providers, carriers, our customer management software, AI providers, email delivery, payment processing and Google. We choose these providers and may change them.
25.2 We are not responsible for their outages, errors, changes, price increases or policy decisions. That includes a carrier's decision to filter or block messages, and Google's decisions about your listing, your reviews or your ranking.
26. No promise of results
26.1 We do not promise a number of visitors, calls, inquiries, bookings, customers, jobs or reviews, a star rating, any revenue, or a position on Google, in AI search tools or in other search engines.
26.2 The service is provided as it is and as available. We work to keep everything running, but we do not promise that the website, the phone number, the texts, the chat or the reports are free of interruptions or errors. We may take parts of the system offline for short periods for maintenance.
26.3 We keep backups of the website for our own operations. Keep your own copies of the material you give us.
26.4 Apart from what these terms say, we give no warranties, as far as the law allows.
27. Limits on our liability
27.1 Our total liability to you, for everything connected to the service or these terms, is limited to the amount you paid us in the 3 months before the event that caused the claim.
27.2 We are not liable for lost revenue, lost profit, lost customers, lost inquiries, lost data, loss of reputation, or other indirect loss. We are not liable for fines, penalties or claims connected to messages sent for your business (section 12).
27.3 These limits apply to all kinds of claims, whatever their legal basis. They do not apply to loss we cause on purpose or through gross negligence, or where the law does not allow them.
27.4 You must take reasonable steps to limit your loss.
27.5 You must tell us about a claim in writing within 12 months after you discovered, or should have discovered, what the claim is about. After that the claim is lost.
28. Claims from others
28.1 If someone else makes a claim against us, or an authority or a carrier fines or penalizes us, because of any of the following, you cover our loss and reasonable costs, including legal fees:
- content or information you gave us or approved,
- your business or its products and services,
- messages sent for your business, including claims under the Telephone Consumer Protection Act and state laws on texts, calls, emails or call recording,
- the contacts, lists and consents you gave us,
- how you contact or treat your customers and leads,
- your breach of these terms or of the law.
28.2 We tell you about such a claim without delay and give you the chance to take part in handling it. You do not settle a claim in our name without our consent.
28.3 If someone claims that the design or code we created infringes their rights, we fix or replace the affected part, or we end the subscription and refund the month you have paid for. That is your only remedy for such a claim.
29. Confidentiality
Each of us keeps the other's non-public business information confidential and uses it only for the service. This does not apply to information that is public, or that the law requires one of us to disclose.
30. Showing your website as an example
30.1 We may show your website and your business name as an example of our work, on our own website and in our marketing. We do not show your contacts or your results without your permission.
30.2 We place a small "Built by LocalBooked" link at the bottom of the website. It stays for as long as we host the website.
31. Calls and communication
31.1 We may record and transcribe our calls with you, to keep notes, to make the changes you ask for and to get better at our calls. We tell you at the start of the call. If you continue the call, you agree to the recording. If you do not want a call recorded, say so and we turn it off.
31.2 We send notices to the email address on your account. You send notices to [email protected]. An email counts as received on the next business day.
31.3 You agree to receive messages about the service by email. Texts from us are covered by section 37.
32. Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control. Examples are outages at hosting, internet, phone, domain or payment providers, carriers blocking or filtering messages, cyber attacks, power failures, natural events, war, strikes and decisions by authorities.
33. Changes to these terms
We may change these terms with 30 days' notice by email. If you do not agree to a change, you can cancel under section 17. If you keep the subscription after the 30 days, the new terms apply. A change of price always follows section 13.5.
34. General
34.1 These terms, the Data Processing Addendum and the checkout page are the whole agreement between us about the service. They replace earlier agreements about it.
34.2 We may transfer the agreement to a company that runs LocalBooked (section 1.5), to another company in our group, or to a company that takes over our business. You may transfer it only with our written consent.
34.3 If part of these terms turns out to be invalid, the rest still applies.
34.4 If we do not enforce a right at once, we can still enforce it later.
34.5 We are independent businesses. Nothing in these terms makes us partners, or one of us the agent or employee of the other.
34.6 These terms give rights only to you and to us.
35. Law and disputes
35.1 If you have a complaint, contact us first. We both try to solve it within 30 days.
35.2 These terms are governed by Danish law, without its rules on choice of law. The UN Convention on Contracts for the International Sale of Goods does not apply.
35.3 Disputes are settled by the courts of Denmark. We may also bring a claim for unpaid amounts before the courts where you are located.
35.4 Each of us brings claims only on its own behalf, and not as part of a class or group action.
36. Contact
LocalBooked is run by Narto ApS, Lynghusene 26, 4571 Grevinge, Denmark. CVR 46813227. Email: [email protected].
37. Text messages from LocalBooked
37.1 The program name is LocalBooked. If you book a call with us, call us or become a customer, we may text you about your booking, reminders before our call, replies to your calls and messages, and your service.
37.2 Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of booking or purchase.
37.3 Our privacy policy at localbooked.co/privacy explains how we handle your phone number and your consent to receive texts.
